What you have to do The assignment for the unit CHCLEG001 – Work legally and ethically has 3 tasks. Task 1 & 2 are scenario based activities and task 3 is a short answer questions.

Task 1 - SCENARIO In this task you are required to describe an appropriate course of activities/actions that you have undertaken to manage the below mentioned workplace situations in accordance with the organisational legal and ethical requirements: 1. Conducting a performance review of an employee who is continuously underperforming. Now you have to intervene and discuss the disciplinary process with an employee - Ensure the employee understands what is expected of them - Clearly and concisely identify the problem - Organise a meeting to discuss the reoccurring problem - Allow the employee to bring a support person - Explain the concerns to your employee in specific easy to understand terms - Give the employee an opportunity to respond to said concerns before moving forward with any actions - Outline the required improvements and consequences of continued poor performance - Provide a solution to improve performance - Develop a time-frame and schedule routine meetings/check ins on improvements - Document all discussions and meetings/reviews - Monitor performance and provide feedback - Follow any applicable industrial instruments e.g. awards, contracts, enterprise agreements 2. You have identified that one of your practice’s reception staff has accepted a gift from the patient. You have realised that this may turn out to be as potential conflict of interest situation and need to be notified. - Ensure that staff member has notified or filled in declaration of receiving the gift - Identify and determine the appropriate course of action within the company’s policies and procedures - Consider if the acceptance of the gift creates an actual or perceived conflict of interest - Determine whether it can be justified in terms of public interest and can withstand scrutiny - Notify staff member of approval/denial/donation/destroying or returning of gift. -Provide guidance which supports the policies and procedures and regularly remind employees of their responsibilities in regards to gifts/donations.

You have accidently dropped a heavy piece of machinery on your feet while moving your desk and now need to report this injury for further process. - Notify your employer immediately or as soon as possible after the injury has occurred - Fill in report on how you dropped the machinery, when (e.g. moving the desk) and where (e.g. at your desk in office space) the injury was sustained - Seek medical advice from your GP - If fit get a full capacity work clearance from your GP - If unfit to resume normal work duties get a capacity certificate of the duties you are able to do to provide to your employer and their insurer. - In reference to GP advice either stay home to recover or recover at work on suitable duties until you are able to fulfil regular duties. 4. One of the admin clerks in your medical practice has come for an evening shift and looks bit intoxicated. You went pass him, exchanged greetings and can smell alcohol. - Document the observation of employees behaviour e.g. smell of the alcohol, looking to be intoxicated and any other observations there may be - Take the employee aside with HR or a managerial witness to discuss behaviour - If the employee does not have reason for the behaviour or is denying the behaviour ask for the employee to take a mandatory alcohol test (assuming the organisation has one) - Escort the employee throughout testing, then back home or to the place of employment where they can organise someone to come and get them - If the test comes back positive, put in place disciplinary action e.g. suspension, mediation, rehabilitation dependant on the employers policies

Task 2- SCENARIO Staff need to have awareness of their own goal and must evaluate own area of work to determine scope of compliance requirements and possible strategies to deal with different ethical issues. Below are the three different ethical situations provided, which you are required to analyse and develop a strategic response to manage the situation where legal or ethical requirements have been breached. 1. You overhear a receptionist releasing an address and contact details of patient X to patient B, who claims to be an old friend of patient X but has lost the new contact number of Patient X. - Identify staff member(s) involved - Discuss the breach of privacy and the legal breaches that have been made with the staff member - Document the breach immediately - Arrange meeting with staff to identify the conduct that has led to the incident - Implement a performance plan for the staff member - Ensure staff member is up to date with all policies and procedures in regards to confidentiality and privacy - Inform all staff of the policies and procedures that are to be followed when assisting clients. 2. You saw a staff member getting agitated and verbally abusing a young client from diverse culture. -Remove the staff member from the situation - Apologise to the client, provide them with support and understand their anger/frustration in 2

regards to the incident - Document the incident - Address the incident with the staff member(s) involved - Make a written statement for further improvement actions - Develop an action-plan to attempt to resolve the issue - Set a timeframe in which the performance plan will be reassessed to ensure the staff member is not repeating the same behaviours. 3. Two staff members are gossiping about the behaviour of a client. They are laughing about their behaviour and medical problems. One of the staff members involved has no responsibility of the treatment of the client. - Identify the staff member(s) involved in the incident - Discuss the issues of the incident - Document when the incident occurred and who was present - The conduct that is believed to be unethical - Implement a performance plan with staff involved - Inform all staff on correct code of conduct and communicate the process of reporting breaches to all staff members

Task 3- Short question answers 1. What is a value system and explain how a worker’s personal values and attitudes can impact on their work. Values are principles that a group or individual holds in high regard. We live our lives through these values and they impact the decisions we make. A value is formed by a particular belief that is related to an idea or type of behaviour. Values can influence our judgment and impact our support to clients, e.g. differing cultural, religious and political values can impact on the ways we interact with clients 2. Why is it important to share feedback with your staff members relating to the work practices that could be improved to meet legal and ethical responsibilities? It is important to share feedback with staff members relating to work practices as it provides guidance and set standards for employees to follow and understand, without providing them with feedback they may not understand their legal and ethical responsibilities this could then result in breaches and misunderstandings with the code of conduct of the establishment 3. Give an example of at least three workplace improvements that has been designed and implemented in your/any other organisation in order to enhance the workplace responsiveness to legal and ethical requirements. - Training/Work-shops on the company’s legal and ethical policies and procedures - Displaying posters/brochures for all staff members to read in easy to spot places e.g. lunch rooms, staff rooms, around the office space - Sending out routine emails and updates on any changes to the legislations and policies and to ensure all staff is updated in a timely manner on the changes.

List down the sources from where you can gather information about the legal and ethical requirements that apply to your work role? - RACCGP - Government notices -Trade unions -Internet - Media - The department of industrial relations specific to your state or territory - Fact sheets/brochures - Legislations e.g. WHS laws - Australian and international standards 5. How would you identify and meet the scope and nature of own ethical responsibilities in a particular work place? Each professional association e.g. health care, welfare work, social work, psychology etc. has its own particular code of ethics and or code of conduct when accepting the code of ethics it will ensure the safety, well-being and rights of clients within the workplace. A code of ethics is only useful if it is part of everyday work practice. When adhering to these codes it is easier to put aside your own values and work within the workplaces policies and regulations.
