Interrogation #1 - Suspect can’t remember Monday night – later does remember ordered a pizza for dinner, watched news, in bed at 11:30 and his girlfriend went home – now she stayed the night - Suspect is assistant manager in jewelry store o Everyone has the code to security system – thinks Curly could have motive - Wont say much about girlfriend - “trying to help you” several times o checking watch, asking how long it will take - team knows a female was on the surveillance, has fingerprint, and hair sample – know it was a 2 person job o suspect doesn’t wasn’t want to give girlfriend’s name, wants to keep her out of it – not sure what her phone number is (claims she changed her number), not sure where she lives either - changed story: girlfriend was never in the store, but now she’s been in there a couple of times - asked if they thought he did it – doesn’t want to take a polygraph - “not a thief, would never do this to his boss” o record of shoplifting at 10 years old, never got caught by police - team left room, but told suspect not to leave – should have read Miranda - suspect earlier said he doesn’t watch surveillance videos, now says he watched it and saw that the gloves the person was wearing were black - team poses that she manipulated him because he’s a good guy who wouldn’t have wanted to do this to his boss - “if I tell you I did it, can I walk out of here and all of this will go away?” – false confession? o “Am I going to be charged?” - team is coming on too hard with threats “you’re going to burn with her” – you catch flies with honey, not vinegar - In report, state the changes in suspect’s story, don’t just say he was deceptive or lied – just state the facts; might be best to go back and watch video to write report o Weight of the evidence (totality of the circumstances/deception) eventually disproved his alibis and suspect eventually confessed to what he knew happened Interrogation #3 – began at 10:10 am 4/11/2016 - Rape case on a college campus, no physical evidence, surveillance footage of suspect leaving dorm - Was drinking night of incident, says he wasn’t drunk - Team got straight to the point asking about his and barb relationship – no rapport was established - Jim said he went to he party at 9, was home at about 1 – changed story immediately and said he went to barb’s house because she asked him to, made

out and had sex as a casual thing – insists that she wanted him to come over and wanted this to happen Jim claimed both of them were “feeling pretty good that night” when asked if they were both drinking Jim says that Barb has a boyfriend, Mike Jim admits that he has slept with Mary in the past, but cheated on her and now “hates his guts” Team decided to take a break and told Jim to feel free to go grab a water or go to the bathroom When team came back, asked about Mary and their relationship and Jim still insists that she hates him and he does not like to talk to her Jim asked what this is about and team says it’s about a sexual assault that happened after the party – Jim seemed shocked, but still neutral and calm Jim insists that Barb said that she was mad at her boyfriend and wanted to “give him a taste of his own medicine” and asked Jim to come over Jim denied that anything ever went too far – they “both had a pleasant time” Jim has not seen Barb since the incident – Mary has not talked to him and he does not talk to Mary Team confronted Jim with what Barb said about the night, and read Jim his rights and Jim “want(s) an attorney”

Interrogation #4 10:10 am 4/13/16 - Jim  “what’s this about?” immediately before introduction  wants to know why he’s here, insists to know  does not want to answer questions until he is told why he is there  admits to drinking occasionally  deflects questions from the team and wants to get to the real issue  partied last week, friends were there – does not say names, “not going to talk about my friends”  “Mary’s a psycho bitch. You can’t believe a word she says.” - claims they “dated for a while, but it didn’t end well.”  Barb is a friend, was at the party  After the party, suspect went home – Barb said they went to her place – “She tell you about that?”, changed answer – admitted he drank more, talked, and had sex there; “didn’t say she didn’t” want to have sex with him – blamed it on the way she was dressed (shirt and underwear)  Admits that they dated in the past  “She didn’t leave, she didn’t day no. She wasn’t trying to stop me.”  When told that she is accusing him of sexual assault, suspect pauses and exhales, starts to tap feet and puts hand over mouth  “Can I talk to Barb now? If I can talk to her now I can clear this up.”  “What’s the big deal?”  “ was really blasted. I don’t remember every detail.” When asked if he called before he went over  Asked why his previous record of rape would have anything to do with this. – becomes more hesitant and quiet

   

“I did not force myself on Barb.” “I didn’t hurt her.” When told quotes form Barb from the incident, stops fidgeting and gets a blank look on face Did you assume too much, this happened before, maybe you just didn’t read the signs. These things happen to a lot of college students. “Did you take her comfort when you got emotional the wrong way?” you weren’t thinking clearly? o The way she was comforting you was the okay signal to have sex with her? o Combination of family, school, and relationships were stressful o Did you have sex with her because you were drunk and she was dressed provocatively, or were you stressed out and needed comfort and just made a bad choice in the moment? o Confessed “made a bad choice, assumes she was willing when she wasn’t”

Interrogation #5 10:10am 4/15/16  Describe yourself in 3 words: work hard, loyal, don’t have a lot of money  Lived here all his life  In a relationship – when asked to elaborate, asks “why?” – been in a relationship for several years – Bob, live together for about 5 years  Both work, money isn’t an issue – Bob works at Macy’s in Men’s clothing  Larry has been working at the jewelry store since high school – “loves” the owner, “loves” working there  Normally works Monday-Friday  Had a day off last Monday, went to Tortuga with Bob  Closing: lock all cases, make sure no one’s in the store (burglar tried to hide in the bathroom before – a couple years ago)  Security system is very out of date and unreliable  Other workers are reliable people – about a dozen females work there, doesn’t “want to point a finger at anybody else” when asked if any of them are suspicious  Barb is boss’ daughter in law, Mary has been working there longer than Larry – thinks Jim (owner) will have Mary take over business – both have good relationships with Jim  Owner’s wife has code as well - “Don’t know why she’d do this” without being asked specifically if she did it – doesn’t think any one person could have done it “no one I’d want to point a finger at”  Mo was closing the shop on Monday, Mo is single, but “goes through women pretty quickly” – has brought in some of his women to the store  Mrs. Jones and Barb are the only ones who get along, Larry tries to avoid her  When asked what kind of punishment should happen? “I don’t know anything about this.” “Whoever did this has to pay for it.”  Sometimes Mr. Jones lets the women in the store wear the jewelry to show it off to customers

  





Everyone was surprised to find out about the theft Mr. Jones sometimes gives jewelry to Mrs. Jones, could probably have it if she wanted it – they are a wealthy couple Woman on surveillance “didn’t look familiar to him” - Mrs. Jones is short and squatty, Barb, is average height, the woman on tape had more of a model figure, doesn’t know much about Mo’s girlfriends – Mary’s build is closer to the tape, thin, but “pushing 60; too old to be a cat burglar” “I would like to help you, I just don’t know. I wish I could point to somebody.” “Didn’t look like any of the women I work with.” “Not going to betray my boss; I think whoever did this did.” “I hope they go to Hell.” “If I did, I would tell you. I’m not protecting anybody; you’re not listening to me.” May be telling us the truth, got all the information we could out of him, and he left. May need to talk to him in the future.

Interrogation #6 10:13 am 4/18/16  14 and 13 year old kids, one of each  Jim Johnson owns Johnson insurance, inherited business from father – wife works there in with him  Been living in neighborhood for 10 years, neighbors are close knit  Usually goes out to eat on Friday nights – went out that Friday, right after work at about 5pm, met with another couple  I not willing to give any more answers than necessary – one word simple answers  When told why he was called in, wants to know how the child hit was doing  Said the car was just a junker, both he and wife have access  Johnson says he doesn’t know who the boy is but asked if he is going to be okay  Asks if this is going to take long – when asked specifically about incident, “I told the officer last night about this”  Said wife got headache and wanted a prescription, asked Jim to go to the store, that’s when he saw car was gone  Doesn’t know if there was anything in the car when he left it  Was told that they found his car while he was being fingerprinted – seemed very calm, no change in manor about this  No eye contact, gazing off in distance, angling away from team  Kids were home all night “they didn’t do this” without being asked specifically about them  Mentions rowdy kids up the street “loud and obnoxious” – doesn’t let his kids hang around with them  When asked what do you think should happen to the person who did this, “I don’t know who it was”  Confrontation: downward gaze, “I don’t know” when asked how he thinks the parents of the child feels or how would he feel if it were one of his kids – consistently deflects  “my son doesn’t drive”  “I’m sorry he got hit.”







Team is trying to minimize and hit Jim with emotional evidence, “you’re not the first person that has gotten into an incident like this., you’re a goo father, you’re a good person who should want to help us.” o ‘I was driving the car. “Just me” – driving to the liquor store to get more – thought it was a garbage can, “didn’t know I hit anyone o Went out to eat, had a few beers while watching the hockey game when they came back, wife asked him to go get her meds, she didn’t know how much he was drinking. “I would have stopped if I knew it was a person.” “I panicked. I parked the car and walked home” o Prints on the beer bottle “should be” his Asks if this is just a ticket, - Admits it was “my son, he was driving. I told him to drive” he was with him in the car “He only did it because I wanted him to. It was my fault” – has taken his son out driving a couple of times – wife can confirm his statements “I knew he hit something. I told him to drive away I told him to pull into a parking lot and we walked home.” “Will I be able to go home?” – team then gives him Miranda – would arrest Jim for child endangerment, will charge son, but not arrest child, refer juvenile’s case to state attorney with a recommendation for restorative justice...
