1.0 Title of Research The issue in developing Malay reservation Land in Kampung Baru, Kuala Lumpur.

2.0 Research Background The Malay Reserve Land (MRL) can br defined as the land owned by the Malays. The Malay reserve land is stipulated under the Malay Reservation Enactment (Cap 142), which had been in force since 1913 and amended from time to time (Turnbull 1989; Sandhu 1964). Currently, most of Malay reserve land are either left idle or underutilized. Compared with its neighbors, Malay reserve land is considered as lagging behind its neighbors’ economic development (Trezzini 2001). The land value for the non-Malay reserve is more than four times the value of Malay reserve land (Buang 1997). Besides, issues related to the development of Malay reserve land are focused on the legislative barriers such as restrictions in land dealing, collateral, and multi-level ownerships (Yusof et al. 2010). Kampung Baru, Kuala Lumpur was gazetted on Jan 12, 1900, and administrated under the Malay Agricultural Settlement. It covers a 120ha area, is around three times the size of the land of KLCC with six integrated villages: Kampung Periuk, Kampung Masjid, Kampung Atas (A and B), Kampung Hujung Pasir, Kampung Paya and Kampung Pindah. A land area of 30,000 sq ft, or 0.28 ha would allow the project to reach the 1:10 plot ratio as set by Kuala Lumpur City Hall for commercial development. As one lot in Kg Baru usually has about 4,000 to 5,000 sq ft (0.04ha) while a maximum lot is about 16,000 sq ft (0.37ha), one would need about four plots to fulfil the minimum requirement of 0.28ha. Kampung Baru consists of seven kampungs. Interestingly, each kampung has a their own character in line with the ancestral roots of the villagers. 3.0 Statement of the problem a. Kampung Baru can only be inherited, inhabited and rented by/to Malays. The Kampung Baru Development Corporation Act 2011, states the establishment and functions Kampung Baru Development Corporation (PKB). And, according act, the corporation is the main coordinator for the development, redevelopment and improvement of the area.

Moreover, Kampung Baru is divided to several main areas: 1. Malay Agriculture Settlement Area: A 222.76 acres wide where the 7 kampungs are located 2. Jalan Raja Bot Market’s Reserved Land: A 44.3 acres of developed land 3. Area outside MAS: A 40.29 land owned by DBKL and Perbadanan Kemajuan Negeri Selangor (PKNS) As a result the Kampung Baru the land cannot be sold, cannot be occupied or even be rented by the non-Malays. b. The Malay reservation land cannot be transferred to the non-Malay developers. Due to the limitation to trannsacted the land to non- malay, it result to the price is decrease compared to the normal price in the market. But some developers also believe that the lack of modern infrastructure can cause the price of Kampung Baru land to be that low. c.

Multiple ownership and overlapping ownership land

Multiple land ownership has exist since its establishment by the British colonialist through the Malay Reserves Enactment 1913. The mechanism of inheritance of land to too many heir sometimes creating issues of overlapping of title eventually diffcult the process of land developmen. The heritance of land said orally and without the legal document of the agreement causing the land be diffcult to claim and resulting to multiple ownership. Just imagine, A 7,000-square-foot piece of land has about 200 owners. An owner has passed away but the name change has not been done. As long as the faraid solution has not been implemented, so long as the name change is not possible. Therefore, inheritance cannot be inherited in case of Kampung Baru Land.

4.0 Research Question The research questions that can be identify are including: a)

What are the the issue/ disputes arise in developing Kg. Baru?

b) What are the perception of landowner about the compensation and their comment on the redevelopment. 4.1 Research aim The aim of this research are to investigate the issue and disputes arises in developing Kg. Baru.

5.0 Reserch Objectives The objectives of this research are: a)

To identify the issue and disputes in development Kg. Baru.

b) To investigate the perception of resident of kampung baru in developing their land.

6.0 Research Scope and limitation The scope of this research are the issue/disputes arises in developing Kg Baru as it stipulated under Malay Reserve Land enactment. The scope of this research is focusing to the landowner of the land Kampung Baru, Kula Lumpur. The limitation is perception of the landowner/ resident toward the government intervention in developing their land.

7.0 Research Methodology 7.1 Research Design This research are using qualitative method, all the data are been collected through personal interview and questionnaire. Besides, to sought to find out the landowner and the resident of Kampung Baru perception toward the redevelopment of Kampung Baru.

7.2 Research Sampling Random sampling type be conducted among the population of 45,000 in area of 101.2 hectare of resident Kampung Baru, Kuala Lumpur as a guide to distribute the questionnaire.

7.3 Data Collection Method The collection of data are through questionnaire. An interview will be conducted if neccasarry if there are not enough data.

7.4 Data Analysis The resident of Kampung Baru, Kuala Lumpr be approch through questionnaire then the information from the questionnaire will be entered into the Statical Package Software System (SPSS). In addition, an interview be conducted to clarify any argue point as well to clarify basic fact on the history of the area.

8.0 Summary of Chapters

8.1 Chapter I - Introduction The Malay Reservation Land is a special category of land confined within the boundaries of a state which can only be owned and dealt over by Malays or persons deemed native resident of the state. Under the law, any revocation of such land can only be apply if there is a piece of land with similarity of chracter and size which does not exceed area of the said land. Besides, the Malay reserve land are mostly fallen behind of the development compared to other type of land.

In addition an interview be conducted to clarify any argue point as well to clarify basic fact on the history of the area.
