Description

1. Identify and discuss two different goals that the criminal justice system has. Two goals that the criminal justice system has are preventing crime from occurring and securing the safety of citizens. 2. What are two different types of deterrence? Describe each type. General deterrence is an idea that involves people seeing punishments given to people for their acts, and as a result, they will be less likely to participate in that particular act. Specific deterrence occurs when someone is punished for an act to prevent them from continuing to participate in it. 3. Why are victims considered the first “gatekeepers” of the criminal justice system? They are referred to as this term because they make the decision to determine to report or to not report a specific crime. In many situations, a victim can choose to press charges. 4. What is probable cause? Describe a situation where there would be probable cause? Probable cause occurs when a suspect has high enough potential guilt of a crime to be seized. If someone is fleeing a scene where I crime had just been committed, they can be taken into custody as a suspect. 5. What are some of the differences between the adult and juvenile court processes and systems? The age varies based on each state. Some 14 year-olds can be tried as an adult. It also depends on the crime. Stealing a pack of bubblegum will most likely be thrown out if he/she is even arrested. If a child kills someone, then he/she will most likely be tried as an adult. Juvenile cases also begin with a petition instead of criminal charges. Critical Thinking Questions 1. Do you think that punishments deter crime? Why or why not? Do you think there is a better way to reduce crime than punishment? I believe it does because if someone breaks the rules, then there needs to be consequences. If someone breaks the rules and does not get punished, then more and more people will start participating in these acts and society will become much more violent. If you go back hundreds of years, some societies took a more religious approach. They believed that God may chose to punish someone for their sins. This did reduce crime because of the believe of going to “Hell.” I believe more treatments should be implemented into society. There should be more institutions. 2. Do you think that alternative sanctions such as boot camps are positive or negative for society, individuals, and the criminal justice system? Why? I believe they are positive because they teach youth strict rules and how to behave. This would positively benefit a society especially for young kids who are growing up in a negative atmosphere. 3. Why do you think more victims don’t report crimes? How does this affect the criminal justice system?

I believe they may feel scared because the criminal may belong to a gang who may come after them. Another reason is that they may not have the money or time to go to court and pursue this crime. 4. Do you think juveniles should be tried in adult courts? Why or why not? What effects are there from trying juveniles in adult courts? I believe it depends on the crime. Murder is a very serious crime and they should be tried in adult courts for this. It really depends on their level of threat to society and if recovery is a good option. They may get a lot longer punishment time from this. 5. Do you think that parole is a positive or negative element in the criminal justice system? Why or why not? What effects does it have? Should officials be stricter about parole? Why or why not? I believe it is a good step in many situations. If a criminal wants a second chance in society, they will have to earn it. Constantly showing good behavior will help them understand how to live a better life and not put others at harm. The officials need to be strict so the criminal will not return to his/her bad habits....
