MODULE 2: Legal Basis Objective: To understand and identify the specific provisions of the fundamental law and pertinent Republic Acts as basis of the ROTC Program. INTRODUCTION From being a compulsory military training for all college students under the National Defense Act, the Reserve Officers Training Corps (ROTC) Program is currently one of the three components under the National Service Training Program (NSTP), making ROTC optional. SECTION 4, ARTICLE II OF THE CONSTITUTION Section 4, Article II of the Constitution states that the prime duty of the Government is to serve and protect the people and that the Government may call upon the people to defend the State wherein all citizens may be required, under conditions provided by law, to give personal military or civic service. COMMONWEALTH ACT NO. 1 (NATIONAL DEFENSE ACT OF 1935) dated 23 December 1935 It was the very first statutory enactment by the Commonwealth government which required the compulsory military training of all college students. Section II, paragraph A, states that the preservation peace and safety of the State is an obligation of every citizen. The Army of the Philippines shall consist of the Regular Force and the Reserve Force. Provides that during national emergencies the government has its power to mobilize its citizen when in times of national emergencies

PRESIDENTIAL DECREE 1706 (NATIONAL SERVICE LAW) dated 08 August 1980

Military service will no longer be compulsory but leaving the National Service Training to be in effect. Composed of three components: 3 components: Military Training Service (MTS), Civic Welfare Service (CWS), Law Enforcement Service (LES).

MEMORANDUM NO. 11 dated 1986 A memorandum by then President Corazon C Aquino which suspended the implementation of PD 1706. REPUBLIC ACT NO. 7077 (CITIZEN ARMED FORCE OR AFP RESERVIST ACT) dated 27 June 1991 Section 38, Article VII states that “Military training for students enrolled in colleges, universities and similar institutions of learning is mandatory pursuant to the provisions of the National Defense Act of 1935 and the 1987 Constitution. It prescribed for a two-year ROTC Program as a requirement for graduation to all tertiary level students. REPUBLIC ACT 9163 (NATIONAL SERVICE TRAINING PROGRAM (NSTP) dated 23 July 2001 An act that made ROTC optional and required male and female taking baccalaureate degree courses and of at least two (2)-year technical-vocational courses to take NSTP which is consisting of three components. These three components are: Reserve Officers Training Corps (ROTC), Literacy Training Service (LTS), Civic Welfare Training Service (CWTS). Ø Reserve Officers Training Corps (ROTC) -The ROTC is designed to provide military training to tertiary level students in order to motivate, train, organize and mobilize them for national defense preparedness. Ø Literacy Training Service (LTS) Literacy Training Service (LTS) -is a program designed to train students to become teachers of literacy and numeracy skills to school children, out of school youth, and other segments of society in need of their service.
