Analyse how this influences and maintains safe practice at Merryvale residence or Cherry trees children’s centre case study

This legislation makes sure that everybody has a responsibility to put health and safety in place to protect everybody involved. The act ensures that businesses put things in place such as risk assessments and health and safety procedures. The management Of Health and Safety at Work regulations is about making sure that any risks involved at work are kept to a minimum and that safe options are available.

A procedure In place to support this legislation is a maintenance procedure, this procedure makes sure ‘to maintain a high standard of maintenance and safety’ (wellbeing residential, 2017) Another example is the first aid policy and procedure, which I in place to ensure that accidents are dealt with properly, ‘provide first aid support to someone if they are injured or become unwell in school’ (Milner school of English, 2015)

In the cherry tree’s case study it is evident that that there is a broken climbing frame that the children play with which was noticed by the staff/volunteers and not reported, this doesn’t follow these legislation as it wasn’t brought to the attention of somebody who could have done something about it, if the climbing frame had been moved or fixed then the accident that happened could have been prevented. These legislation should influence cherry tree’s because the centre should have carried out a risk assessment in order to estimate how dangerous the climbing equipment is and how to go about using the equipment as safely as possible which also wasn’t followed correctly.

If these ideas were implemented Into the Meryvale residence then the area would be a lot safer for the residence and there would be a lower risk of infections and disease.

These legislation should be implemented in Meryvale in many ways, firstly there should be a refreshed manual handling training course for all of the staff as it is evident that the lady with the bruises on her body was not handeled correctly and in the right ways as she was clearly hurt and bruised in the process of moving her. Secondly it should be noted by the staff that not all service uses needs manual handling, some may be able to move themselves safely, this is important because eit makes sure that the risk of manual handling isn’t made if its not needed, Thirdly risk assessments should be made when 2

If RIDDOR was applied well to the cherry tree’s case study then fewer accidents could occur in the near future because they would have been reported.

Similarities These 2 pieces of legislation are similar because they are both legally required which means that employers know that they cant ignore the rules they have to follow which ensures that vulnerable people are safer. Another reason that makes these legislation similar is that they are both in place to prevent harm; both ensure that there are polices and procedures in place to prevent harm from happening instead of fixing problems in the future which can use more time and resources. Another similarity is the fact that both legislation cross over in the fact that some service users may not be able to distinguish between chemicals and a safe drink which is where both legislation come in to ensure that the both don’t get mixed up an cause more damage.

Differences These 2 pieces of legislation are different because te control of substance hazardous to health is about the storage and disposal of chemicals where as the food hygiene regulations is about the safekeeping and usage of food and ensuring its safe to be eaten. Another difference is that there are different ways that damage is caused to the system from what both legislation is about, for example with COSHH the chemicals can effect the skin by burning it or irritation, where as with the food hygiene problems the results are generally more internal casing bodily issues instead of physical external body issues.

Legislation: The Food Hygiene Regulations Related policy and procedure that a HSC setting (Merryvale or Cherry Trees) should have in place to meet the requirements of this legislation: Food safety policy and procedure

WHY is this legislation, policy and procedure an effective way to maintain health and safety in this setting? (This section MUST include references, in text and in a reference list at the end) This legislation and the related policies and procedures are effective because of several reasons, firstly the legislation stops the staff and service users from getting food poisoning, this means that extra staff aren’t needed to look after the sick service users and staff to cover shifts that ill carers have taken off from the poisoning, ‘ Good food hygiene is essential to make sure that the food you serve is safe to eat.’ (food standards agency 2018) Another reason why this legislation is effective is because it s a preventive measure rather than fixing new problems, this is good for a care home because it means that less time, money and resources are needed in the long run, the legislation also prevents damage and risk, In the Meryvale residence this legislation would prevent illness from spreading as it promotes safe practice when preparing food meaning that less bacteria and disease can get to other people, the spillages of food in the residence are dangerous as a slipping hazard to unstable service users and can also help spread disease if not disposed of properly. However, some difficulties involved with this include that training staff with new food hygiene laws can cost a lot of money when care homes have a high turnover meaning that they’re needing to spend the money to train new people often, another difficulty is the money for supplies and staff to be in charge of ensuring that hygiene is kept at the best level. things, firstly the legislation ensures that there are always staff who are trained in first aid, this means that should any accident happen there is always somebody there who can deliver basic medical attention until more help comes, ‘First aid education can save lives in situations of an employee falling ill or being involved in an accident’ (alsco 2017) Another point is that having this legislation means that risk assessments are taken on possibly dangerous activities which means that less dangerous changes can be made, this results in less injury or none at all, In the cherry tree’s case study a risk assessment should have been made in order to check the risk of the climbing frame, if this had taken part then Lisa may not have injured herself as something would have done about the faulty equipment. Some difficulties to this legislation include how risk assessments take time and sometimes that time may be difficult to find when working in a busy environment, another difficulty is that it can cost a lot of money to train staff or pay for training sessions then don’t turn up to the training as this is a waste of money and time and the staff are then still not fully trained.

Concluding points about why legislation, policies and procedures are important to maintaining health and safety in either Cherry trees or Meryvale: Overall legislation, policies and procedures are essential for maintaining health and safety because the staff know how to safely prevent situations from happening, but also know how to handle crisis when they happen meaning that less damage is done. Legislation helps to prevent service users from risk and unsafe practice as it gives a legal obligation for employers to provide good service, However it can be costly to train high turnovers of new staff and eeping track of updating those training.
