Ashley Salinas Business Law 2321—PO1 September 9, 2021 Professor Trautman Reaction # 1c: Customer Injuries: An Introduction to Tort Law Customer Injuries: An Introduction to Tort Law was written by Professor Lawrence Trautman, Thomas Freeman, Vanessa Johnson and Lora Koretz. In this article tort law is discussed in nine parts. The article begins with an introduction about tort law in a business setting. The authors then go on to discuss how the necessary elements that creates a successful tort action. Third, Professor Lawrence Trautman and his colleagues will talk about intentional business torts. Fourth, cyber torts are discussed in great detail. Environmental torts will be the fifth part. The sixth part discussed in this article is medical torts. Next, torts arising in a global pandemic are discussed. The eighth part is the discussion of risk reduction. Finally, the article concludes with the discussion on the law of torts. A Civil Action, Erin Brockovich, Class Action, Dark Waters, and the Rainmakers are examples of the law of tort pertaining to injury to the customer and stakeholders that have been depicted in the cinema. On page 9 of the article the authors define tort as “an omission (failure to act) or a wrongful act (other than breach of contract) against a person or property.” In order to prove a successful tort claim: duty, breach, causation, and damages are the necessary elements. Tort law compensates victims for both their physical injury, as well as in certain situations any harm to their reputation or psychological well-being. Assault, battery, false imprisonment, intentional infliction of emotional distress, fraudulent misrepresentation, defamation, and invasion of privacy are examples of intentional torts.

The victim could recover the charges for misrepresentation if the elements described on page 15 of the article: (1) “someone makes a false statement or opinion; (2) that person intends to induce the victim to act or refrain from acting; (3) the victim justifiably relies on the misinterpretation; and (4) the victim suffers a loss as a result” are met. Defamation arises when someone makes a false statement about the victim that is communicated negligently to a third party and causes injury to the victim's reputation. Libel (written-form), and slander (spoken form) are types of defamation. The victim can recover from privacy invasion when the victim's right to privacy has been infringed upon. An unreasonable intrusion into the victim's seclusion, the unauthorized appropriation of the victim’s name or likeness, the unreasonable publicity of the victim’s private life, and the publicity that unreasonably puts the victim in a false light in public are considered the ways the ways in which invasion of privacy occurs. This article is organized and structures in a user-friendly manner. The subsections of the article made it easier for me to read about different types of tort law. The article provides crucial insights about tort law as it relates to the business world. The article has had a significant impact in both my academic and professional life in the accounting field because it has made me become more aware of the types of tort law that exist. I found this article to be highly educational and descriptive in its explanation of the various types of tort law. From the article I have grasped a better understanding of tort law, and the components to making a successful tort claim. In conclusion, Professor Lawrence Trautman did an excellent summarizing and explain the different types of torts. I found this article to be very educational and informative. In my opinion, it is always beneficial to learn about the different types of torts and how to successfully create a torts claim....
