Description

What is meant by the term Corpus Iuris Civilis? The name translates to ‘Body of Civil Law’ and it is the modern name for a collection of fundamental works in jurisprudence that were issued by the Emperor Justinian. Is it the original title of Justinian’s compilation of Roman law? The original title is ‘Digesta seu Pandectae’ which translates to Digest or Pandects. Were these officially compiled during Justinian’s lifetime? Partly compiled during his lifetime. What are the constituent parts of the Corpus Iuris Civilis? The first part was the codex Justinianus, the second the Digest (digesta) or Pandects (Pandectae), the third was the Institutes (Institutiones) and the fourth was the Novels (Novellae Constitutiones Post Codicem), What are the Novels? The novels are a later series of laws passed by Justinian, they were mostly produced in Greek between 534 and 565. What differences are there between the Institutes and the Digest with regard to their layout and content? The digesta was compiled of juridical statements that could be cited for law, they were often extracted from authorized jurists and the majority of them were rephrased for clarity and conciseness. On the other hand, the Institutiones was an elementary textbook, or rather an outline of legal institutions that first year law students could make use of. What do the introductory constitutions to the Institutes and the Digest tell us about Justinian’s policies? It reveals that he was very much interested in reforming the law in order to make sure that it was still applicable to that society, as the Romans had deeply believed in the paramount importance of the law. ?????? What does it contain? The digest contains the name of the jurist, the work and the number of the book What kind of work is Justinian’s Institutes? It is an outline of the legal institutions that first year law students can use in their studies. 4 centuries later Justinian then decided to use the institutions later and enact them as statutes. When and how was the Code compiled? The code was compiled on 7 April 529, but it did not survive so another was produced on 16 November 534. It was made up of the constitutions of the Roman Emperors. When and how was the Digest compiled?

The digest was issues in AD 533 under Tribonian, and it was made of writings by Roman jurists, whilst also constituting both the current laws of the time and a turning point in Roman law. nWhy was a second Code required?
