Description

Introduction For the past century, the concept of equality has been an issue concerning almost every individual. However, in this fast paced modern world, many are now battling for marriage equality. The idea of marriage equality is out of reach for many of Australia’s Lesbian, Gay, Bisexual, Transgender and Intersex (LGBTI) communities till this date. Marriage is defined as ‘the union of a man and a woman’ under the Marriage Act 1961 (Cth) (Marriage Act). Such definitions discriminate against the LGBTI society denying them their right to marry. For several years since the validation of the Marriage Act, same-sex marriage has been listed on the political agenda of various countries including Australia, as a component of the extensive debate about the acknowledgement of same-sex relationships. The fundamental human rights principle of equality by ‘The Australian Human Rights Commission’ believes that civil marriage should be legalised to all couples without discrimination and regardless of their gender identity (Goldberg & Kuvalanka, 2012). Based on the Commission’s submissions into inquiries of the parliamentary federal bills, this paper underpins how marriage equality gets legislative recognition through the human rights principle of equality.
