Thank you for contacting our office. It was a pleasure to talk with you yesterday the 18 May 2018. Under the Migration Agent Code of Conduct a copy of the Consumer Guide is attached to this letter.

As discussed in our office interview I am hereby giving general introductory advice based on the information you have provided me on 18 May 2018. Although my advice is accurate at the time that it is given, I cannot predict future changes in the law and cannot guarantee that the advice will still be accurate at the time when you apply for a visa application.

The query raised by you regarding the Skilled Graduate (Temporary) (Class VC) Subclass 485. As per your recent approach to our office and requesting explanation on court’s decision and how that effect’s the applicants applying for Subclass 485.

After considering your situation and current circumstances I am trying to provide you with the best possible solutions available in regard to your matter. Advice is based on the information available and this letter or content cannot be used for submission, not suitable for submission due to lack of documentation. Following advice will help you to consider your future actions in relation to refuse to grant Skilled Graduate (Temporary) (Class VC) Subclass 485 visa. You received from Department of immigration and border protection on 31 March 2018 and along with further advice regarding further steps for review.

After completed your study in 4th April Jan 2018, you have applied Skilled Graduate (Temporary) (Class VC) Subclass 485 visa on 28th Feb 2018 with the timeframe under Regulation 485.213 (a) of Schedule 2 to the Migration Regulations 1994i. In 485 visa application, the applicant was required to nominate a skilled occupation and your nominated occupation is “Civil Engineer”. Applicant also had to satisfy the Minister that his obtaining the Diploma satisfied the “Australian study requirement,” and Diploma was” closely related” to the skilled occupation he nominated under Regulation 485.213 (b) of Schedule 2 to the Migration Regulations 1994ii.

Minister refused to grant the applicants 485 Visa because he concluded the applicant did not satisfy the Australian study requirement. Diploma was not closely related to the applicant’s nominated skilled occupation “Civil Engineer”.

The tribunal concluded that applicant satisfy the Australian study requirement but found the diploma was not closely related to the applicants nominated skilled occupation of “Civil engineer”. On its discretional powers the tribunal identified a “wrong issue” in the applicants case. The tribunal misconstrued or misapplied the expression “diploma that is closely related to the applicants nominated skilled occupation. That appears in 485.213(b) section 2 to the migration registration 1994. And made a jurisdictional error.

I have also attached the documents, which states our fees and obligations as a migration agent.
